The man charged in a hit-and-run that injured a 4-year-old appeared before a judge Monday afternoon.David Nelson Duphiney, 58, was charged with a hit-and-run with great bodily injury.The family of Jayce Rainey said he was airlifted to the hospital after being hit while riding his scooter on Sanders Street Sunday.Rainey was playing with other children in his grandmother’s front yard before he was hit, according to Chief Barry New with Honea Path Police Department.Duphiney was quickly taken into custody, New said. More than a dozen family members and friends gathered in the courtroom to support Jayce.The child’s grandfather told WYFF News 4 the child has serious injuries and has a long road to recovery.He told the judge what he witnessed on Sunday.”He hit him in the street like road kill. This monster on the screen, my grandson can’t get out of the hospital. Why should he be able to get up out of that cell?” Douglas Rainey said.”Justice wasn’t served. For a four-year-old baby to be playing out in the street and for him to hit him and run, that’s not fair,” Valentina Lee, Jayce’s aunt, said.The judge set the bond at $5,000 and Duphiney’s next court date is Dec. 20. Jayce’s family said the boy underwent surgery Monday and is turning 5 years old in a couple of weeks.
